Disclaimer of NCGA said "Photos of House and Senate Members on the individual NCGA Website member webpages are not published on the NCGA Website until we receive copyright release from the photographer so these specific photos are considered in the public domain once they are published on the NCGA Website." Although NCGA may not hold the copyright. but the photographer do. These photos cannot be considered to be in public domain per COM:PCP.

  • Keep, or at least try to seek clarification. This seems overly pedantic. I understand the disclaimer to refer to any photos that differ from the uniform grey-background headshots that appear on this page (example). The grey-background headshots appear to be works of the NCGA. I am not sure what you are to argue as the disclaimer is very explicit with regard to copyright releases being secured before uploading to the NCGA website from the original rights holders in these very few cases.
