This 1954 sculpture is the work of Felix de Weldon, erected with a copyright notice burnished in gold. Per Commons:Copyright_rules_by_territory/United_States#Freedom_of_panorama, the US does not allow public sculptures from this date unless there is a specific release from the artist. This is a privately funded sculpture, using private money; it is not a work of the US government. The Smithsonian confirms the information about sculpture but gives no mention of the artist releasing the work of art into the public domain. The photographic inspiration for this sculpture was taken by Joe Rosenthal while working for the Associated Press; the AP later released the photograph into the public domain. However, a sculpture inspired by the photograph is a new work of art, and requires a new release to enjoy unfettered public usage.

There was a previous discussion about this at Commons:Deletion requests/Category:USMC War Memorial, and the decision was keep. The primary justification seems to be failure to renew the copyright on the sculpture, as researched by @Clindberg: . – BMacZero (🗩) 23:25, 10 August 2020 (UTC)[reply]
Also note that there are images here that do not significantly depict the sculpture and so should be kept regardless. – BMacZero (🗩) 23:29, 10 August 2020 (UTC)[reply]
Keep all of them as per the previous DR. You probably should have looked into this before you started. It would have saved you a lot of time. For example, the link to the previous DR is on the talk pages for all the ones nominated the last time, such as File talk:USMC War Memorial Night.jpg. Something else to keep in mind: we here at Commons are pretty vigilant about this sort of stuff, and although some things do fall through the cracks, that's not usually the case for things as famous as this. Thank you for your attention to copyrights, however. howcheng {chat} 00:49, 11 August 2020 (UTC)[reply]
